Terms of Use

1. Acceptance of Terms

By accessing or using PathCraft LMS software, the pathcraft.digital website, or any PathCraft services (collectively, the “Service”), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.

2. License Grant

Subject to payment of the applicable license fee and compliance with these Terms, PathCraft Digital grants you a limited, non-exclusive, non-transferable license to install and use the PathCraft LMS plugin on the number of WordPress installations specified in your license plan.

Your license is valid for the term stated in your order (typically one year) and must be renewed to continue using the Service after expiry.

3. License Restrictions

You may not:

• Redistribute, resell, sublicense, or transfer the PathCraft software to any third party without written permission
• Reverse engineer, decompile, or disassemble the software
• Remove or alter any copyright notices or license activation mechanisms
• Use the software on more installations than permitted by your license plan
• Share license keys or activation credentials with third parties not covered by your license
• Use the software to create a competing LMS product

4. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Ensuring your WordPress installation and hosting environment meet PathCraft’s minimum requirements
• Complying with all applicable laws, including the Philippines Data Privacy Act (RA 10173) for learner data

5. Payment and Refunds

All license fees are due in advance for the license period. Prices are in Philippine Peso (PHP) unless stated otherwise. Taxes may apply depending on your location.

Refunds are available within 14 days of purchase if PathCraft fails to function as described and our support team is unable to resolve the issue. Refund requests after 14 days are evaluated on a case-by-case basis.

6. Intellectual Property

PathCraft LMS software, including all code, designs, logos, and documentation, is the intellectual property of PathCraft Digital. These Terms do not grant you any ownership rights in the software.

Content you create using PathCraft (courses, quiz questions, certificates) remains your intellectual property.

7. Updates and Modifications

PathCraft Digital may release updates to the software, which may include bug fixes, new features, or security patches. Active license holders are entitled to receive updates during their license period. PathCraft Digital reserves the right to modify features or discontinue any part of the Service with reasonable notice.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

PathCraft Digital does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

To the maximum extent permitted by Philippine law, PathCraft Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of or inability to use the Service.

PathCraft Digital’s total liability shall not exceed the amount you paid for the license in the 12 months preceding the claim.

10. Governing Law

These Terms are governed by the laws of the Republic of the Philippines. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Philippines.

11. Changes to Terms

PathCraft Digital may update these Terms from time to time. We will notify active license holders of material changes by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
